Terms and Conditions
Article 1 – General provisions
1. These terms and conditions (hereinafter the “terms”) govern the purchase of goods and services in the online shop pbtprint.sk (hereinafter the “shop”), including orders placed through the configurators and apps available in the shop, and the relationship between the seller and the buyer.
2. The seller is PBT PRINT, s.r.o., company ID (IČO) 36 507 164, tax ID (DIČ) 2022036027, VAT ID (IČ DPH) SK2022036027, with its registered office at Jána Nováka 37, 080 04 Prešov, Slovak Republic, entered in the Commercial Register of the District Court Prešov, section Sro, insert no. 16379/P (hereinafter the “seller”). Premises: Solivarská 28, 080 05 Prešov. Contact: pbtprint@pbtprint.sk, +421 908 977 573.
3. The buyer is a natural or legal person who orders goods or services (hereinafter the “buyer”). A buyer who does not act in the course of their business when concluding and performing the contract is a consumer and is also covered by the consumer protection provisions.
4. Legal relations not governed by these terms are governed by the law of the Slovak Republic, in particular the Civil Code, for buyers who are businesses the Commercial Code, Act no. 108/2024 Coll. on consumer protection and Act no. 22/2004 Coll. on electronic commerce. The Complaints Policy and the information on delivery and payment published in the shop form an integral part of these terms.
5. By submitting an order the buyer confirms that they have read these terms and agree to them, in the version valid at the time the order is submitted. The buyer will receive a copy of the terms by e-mail on request. By buying products the buyer acquires no right to use registered trademarks, trade names, logos or patents of the seller or of third parties.
Article 2 – Definitions
A consumer is a natural person who, when concluding and performing the contract, does not act within the scope of their business or other commercial activity. A buyer who is not a consumer is a person who acts within the scope of their business activity. Made-to-measure goods are goods made or adapted to the buyer’s special requirements, in particular with your own print, motif, text, name or number, size or colour, or goods intended specifically for one buyer.
Article 3 – Conclusion of the purchase contract
1. The buyer’s order is an offer to conclude a purchase contract. The purchase contract is concluded when the seller confirms the order (by e-mail or by phone). An automatically sent notice that the order has been received by the system is not a confirmation of the order.
2. Before submitting the order the buyer can check and correct the data entered. The technical steps leading to the conclusion of the contract are clear from the ordering process. The contract is concluded in Slovak, or in another language if available. The contract is archived by the seller for the purpose of performing it and is not publicly accessible; the buyer can archive and reproduce these terms.
3. The seller reserves the right to reject an order, in particular if a price was stated by mistake due to a system error, if personal data or a payment card has been misused, or if the order cannot be produced in the required quality. The seller will inform the buyer accordingly.
Article 4 – Rights and obligations of the parties
The seller is obliged to deliver the goods in the agreed quantity, quality and time, to pack them in the way necessary to protect them in transit, to ensure that they comply with applicable legal regulations, and to issue a tax document (invoice) to the buyer. The buyer is obliged to accept the goods, to pay the agreed price including delivery costs and to provide the necessary cooperation (in particular correct and usable source files).
Article 5 – Made-to-measure goods and the buyer’s source files
1. Made-to-measure goods are produced on the basis of the buyer’s source files and requirements. The buyer is responsible for the correctness of the brief (dimensions, texts, colours, placement) and for having the right to use the supplied artwork (copyright, trademarks, personal data and likenesses). The seller may refuse productions that would infringe the rights of third parties.
2. Colours on a screen may differ from the colours on the finished goods (screen settings, material, technology). The quality of the result also depends on the quality of the supplied image; if a source file is not of sufficient quality, the seller will contact the buyer.
3. Made-to-measure goods cannot be returned and the contract cannot be withdrawn from (Article 9(4)) because they are goods made to the buyer’s special requirements. If made-to-measure goods have a defect (e.g. a printing error, damage, goods differing from the confirmed order), the buyer has the right to complain about them under the Complaints Policy.
Article 6 – Ordering
The buyer receives the goods at the price valid at the time of ordering. Before submitting an order a consumer is informed of the total price including VAT and all charges. Orders can be placed through the shop pbtprint.sk, by e-mail at pbtprint@pbtprint.sk or by phone on +421 908 977 573 (Monday to Friday 06:00 – 15:30). The buyer is informed of the delivery time by e-mail. The delivery time and the cost of delivery depend on the delivery method chosen.
Article 7 – Prices and payment
Prices are stated in euros including VAT unless stated otherwise. Prices, discounts and promotions may change without prior notice; the price at the time the order is placed applies to that order. Payment is made at the shop checkout by card or by another method offered at checkout. For made-to-measure orders production may start only after payment has been received.
Article 8 – Delivery of goods
Goods are delivered to the address stated in the order by Slovak Post, Packeta or personal collection. The seller undertakes to deliver the goods no later than 10 working days after the order has been paid, in practice usually within 5 working days; for some kinds of made-to-measure goods the delivery time may be longer, of which the buyer is informed when ordering. If goods are not in stock the seller will inform the buyer without delay and agree the further procedure with them. On receipt the buyer is obliged to check the parcel and to notify the carrier and the seller of any obvious damage or incompleteness without delay.
Article 9 – Withdrawal from the contract (cancellation of an order)
1. A buyer who is a consumer has the right to withdraw from a contract concluded at a distance without giving a reason within 14 days of receiving the goods (for services, from the conclusion of the contract). Withdrawal can be notified by e-mail to pbtprint@pbtprint.sk or in writing to the seller’s registered office; a model withdrawal form, which the seller provides on request, may be used.
2. The goods must be returned within 14 days of the withdrawal, showing no signs of use, with proof of purchase and accessories. The consumer bears the cost of returning the goods. The seller will refund all payments received (including the cost of the cheapest delivery offered) within 14 days of receiving the withdrawal, in the same way the buyer paid; the seller may withhold the refund until the goods have been received or the buyer has proved that they were sent back. If the goods are damaged or worn more than is necessary to establish their nature and functioning, the seller may reduce the refund proportionately.
3. If the delivered goods do not conform to the contract, the cost of returning them and of delivering the correct goods is borne by the seller.
4. A consumer has no right to withdraw from the contract in particular for: a) goods made to the consumer’s special requirements, made to measure or intended specifically for one consumer (i.e. goods with your own print, motif, name or number, embroidery, flags, jerseys and other goods made to order); b) services, if their performance began with the consumer’s express consent and they have been fully performed; c) goods liable to deteriorate or expire rapidly; d) goods in protective packaging that are unsuitable for return for hygiene reasons and whose packaging was opened after delivery; e) other cases listed in the consumer protection act.
5. For made-to-measure goods, therefore, neither return of the goods nor a refund is possible unless the goods have a defect. If made-to-measure goods have a defect (printing error, damage, discrepancy from the confirmed proof or order), the Complaints Policy applies and the buyer has the rights arising from defective performance.
Article 10 – Warranty and complaints
The seller provides a warranty of 24 months from receipt of the goods. The buyer exercises rights arising from defective performance in the way described in the Complaints Policy (by e-mail to pbtprint@pbtprint.sk or in writing to the registered office). The proof of purchase (invoice) serves as the warranty certificate. The seller will issue the consumer a confirmation of the complaint and will handle the complaint within 30 days of the day it was lodged. Obvious damage or incompleteness of a parcel must be reported immediately on receipt. The seller is not liable for defects caused by mechanical damage, incorrect use or care (e.g. washing at a higher temperature than stated on the goods), interference by an unauthorised person or force majeure.
Article 11 – Personal data protection and cookies
1. The controller of personal data is PBT PRINT, s.r.o. (details in Article 1). We process the buyer’s personal data (in particular name, address, e-mail, phone, order and payment data) to perform the contract (Art. 6(1)(b) of Regulation (EU) 2016/679, GDPR), to comply with legal obligations (accounting, taxes; point (c)) and for our legitimate interests, such as handling complaints and protecting legal claims (point (f)). We send marketing messages only with consent, which can be withdrawn at any time.
2. We pass data only to processors necessary for fulfilling the order (the operator of the Shopify platform, payment services, carriers, accounting, IT service providers). We keep data for the time needed to perform the contract and for the period required by law (in particular accounting documents).
3. The buyer has the right of access, rectification, erasure, restriction of processing, portability, the right to object and the right to withdraw consent; rights can be exercised by e-mail to pbtprint@pbtprint.sk. The buyer also has the right to lodge a complaint with the Office for Personal Data Protection of the Slovak Republic (Hraničná 12, 820 07 Bratislava, www.dataprotection.gov.sk).
4. The shop uses cookies and similar technologies. Apart from strictly necessary cookies we store them only on the basis of consent given in the consent banner, which the buyer can change at any time (the “Cookie preferences” link in the footer).
Article 12 – Dispute resolution
If a consumer is not satisfied with how a complaint was handled or believes the seller has infringed their rights, they have the right to ask the seller for a remedy (pbtprint@pbtprint.sk). If the seller rejects the request or does not reply within 30 days, the consumer has the right to file a proposal for alternative dispute resolution under Act no. 391/2015 Coll. on alternative resolution of consumer disputes. The competent ADR body is an authorised legal entity entered in the list kept by the Ministry of Economy of the Slovak Republic (www.mhsr.sk), e.g. the Slovak Trade Inspection (www.soi.sk); the consumer is free to choose. Supervision of compliance with consumer protection regulations is carried out by the Slovak Trade Inspection.
Article 13 – Final provisions
The seller reserves the right to change these terms; a change is announced by publishing it in the shop and applies to orders submitted after its publication. Communication between the parties is usually by e-mail. If any provision of these terms is invalid, the others remain valid. These terms take effect on 25 October 2026.
