Terms of service
Last updated: 26 October 2026
Overview
Welcome to pbtprint.sk! The terms "we", "us" and "our" refer to PBT PRINT, s.r.o., Company ID (IČO) 36 507 164, Tax ID (DIČ) 2022036027, VAT ID (IČ DPH) SK2022036027, with its registered office at Jána Nováka 37, 080 04 Prešov, registered in the Commercial Register of the District Court Prešov, section Sro, insert no. 16379/P. Premises: Solivarská 28, 080 05 Prešov. We operate this store and website, including all related information, content, features, tools, configurators, products and services (the "services"). We use the Shopify platform to provide the services.
These terms of service, together with the policies referred to here, describe your rights and obligations when using the services. Please read them carefully, as they contain important information about your rights and about limitation of liability. By visiting, interacting with or using the services you agree to be bound by these terms and by our Privacy Policy. If you do not agree, do not use the services.
Purchases of goods are also governed by our Terms and Conditions, Complaints Policy and Return Policy. If there is a conflict between these terms and the Terms and Conditions, the Terms and Conditions prevail for the purchase of goods and the conclusion of the purchase contract.
These terms do not limit any rights you have under applicable consumer protection laws or any other statutory rights that cannot be waived.
1. Access and account
By agreeing to these terms you represent that you have reached the age of majority in your country of residence and that you have consented to your minor dependants using the services on devices you own or manage. To use the services, including ordering, we may require certain information, such as your email address and billing, payment and delivery details. You represent that all information you provide is correct, current and complete and that you have all rights needed to provide it. You are responsible for keeping your account login details secure and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.
2. Our products
We make every effort to display our products as accurately as possible. However, colours and appearance may differ from what you see on your screen depending on your device, its settings and configuration. For products with print, embroidery or other finishing, the final appearance may differ slightly from the visualisation in the configurator; the goods always correspond to the confirmed order or the approved design. We may change product descriptions at any time. We reserve the right to withdraw any product from sale at any time and, in individual cases, to limit the quantity of products offered to any person, region or jurisdiction. This does not affect your rights in respect of defective goods.
3. Orders
By placing an order you submit an offer to enter into a purchase contract and authorise us and our payment processors to charge the total order amount to your selected payment method. The purchase contract is formed when we confirm your order, as set out in the Terms and Conditions. We may refuse an order for the reasons given in the Terms and Conditions, in particular in case of an obvious pricing error, suspected misuse of payment details, or if the order cannot be produced to the required quality. Please check your order carefully before submitting it. Made-to-measure goods (with your own print, embroidery, name, number, etc.) are produced according to your materials and cannot be returned or withdrawn from if they are not defective; details are in the Terms and Conditions and the Return Policy. Returns and exchanges are governed by our Return Policy and your statutory rights.
You purchase for your own use or for the use of your company, club or organisation. Businesses and organisations may also buy goods from us for resale if we agree on it.
4. Prices and billing
Prices, discounts and promotions may change without notice. The price charged is the price at the time you place the order, also stated in the order confirmation email. Prices are in euros including VAT unless stated otherwise; shipping costs are shown at checkout before you complete your order. Promotions may have their own terms; if they conflict with these terms, the promotion terms prevail. You agree to provide current, complete and accurate purchase, payment and account information for all purchases and to keep it up to date (email address, billing details, etc.) so that we can complete your transactions and contact you if needed. You represent that (1) you are authorised to use the payment method you provide, (2) the information about it is true and complete, and (3) you will pay the charges incurred at the published prices, including shipping and any applicable taxes.
5. Shipping and delivery
Shipping methods and delivery times are set out in the Terms and Conditions and on the page Delivery and payment. We usually deliver goods within 5 working days and no later than 10 working days after the order is paid; for some kinds of made-to-measure goods the delivery time may be longer, and we inform you of this when you order. We are not liable for delays caused by events beyond our reasonable control, such as carrier or customs delays, natural events, bad weather, network outages, cyber incidents or measures by public authorities. In consumer contracts, the risk of damage to the goods passes to you only when you receive them, unless the law provides otherwise. Check the parcel on receipt and report visible damage to the carrier and to us without delay.
6. Intellectual property
Our services, in particular all trademarks, logos, texts, images, graphics, visualisations, configurators, software, videos and audio recordings, are owned by PBT PRINT, s.r.o., its affiliates or licensors and are protected by the laws of the Slovak Republic, the European Union and other countries on copyright, trademarks and other intellectual property. Purchasing or receiving a product does not grant or transfer any intellectual property rights in the product, its design, software or technology (other than the right to use the product). You may use the services for your personal and own purposes. Without our prior written consent you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any materials from the services, except where permitted by law. Unauthorised use may violate applicable law. All rights not expressly granted here are reserved. The names, logos and slogans of PBT PRINT are our trademarks or the trademarks of our licensors and you may not use them without our written consent. The name, logo and slogans of Shopify are trademarks of Shopify. All other names, logos and marks belong to their respective owners.
Materials you provide to us. If you send us or upload in a configurator logos, graphics, texts, names, photographs or other materials for production, you represent that you have all the rights needed to use them (in particular copyright, trademark rights and the consent of persons whose name or likeness is used). You grant us a non-exclusive right to use these materials to the extent needed to fulfil your order and to archive them. We do not use the materials for other purposes without your consent. We may refuse production that would infringe the rights of third parties or the law. You are responsible for the correctness of your specification (texts, names, numbers, dimensions, colours, placement).
7. Optional tools and configurators
As part of the services we may make available configurators, applications and tools (e.g. for designing jerseys, flags, embroidery or print), as well as third-party tools that we do not monitor or control. We provide such tools "as is" and "as available", with no guarantee that they will be available continuously or error-free. The visualisation in a tool is indicative. Before confirming your order, check your design and the data entered. The use of third-party tools is subject to their terms, which you should read. We may offer new features and tools in the future; these terms apply to them as well.
8. Third-party links
The services may contain materials and links to websites operated by third parties. We do not control or evaluate their content or accuracy. If you choose to leave the services and visit such sites, you do so at your own risk. We are not liable for any harm related to access to third-party websites or to the purchase or use of their products and services. Please read third-party policies before any transaction. Complaints and questions about third-party products and services should be directed to the third party.
9. Relationship with Shopify
We use the Shopify platform, which enables us to provide the services. When you use the services, your device communicates with Shopify's systems. All sales and purchases in our store take place directly between you and us. Shopify is not a party to the purchase contract and is not responsible for any aspect of the sale between you and us, including defects in the goods purchased. Your statutory rights against us are not affected.
10. Privacy
Our Privacy Policy explains how we collect, use and disclose your personal information. Because the services are hosted on the Shopify platform, Shopify collects, uses and stores personal information about your access to and use of the services, including transactions, in order to provide, secure and improve the services, process transactions and prevent fraud. The information may also be transferred to countries other than where you live. Details are in our Privacy Policy and in Shopify's privacy policy.
11. Feedback
If you send us ideas, suggestions, reviews or other content ("feedback"), you grant us a free, non-exclusive, worldwide and perpetual licence to use, reproduce, modify, publish and display it in any medium and for any purpose, including commercial use, to the extent permitted by law. This does not affect your moral rights or your rights to data protection. You also represent that (1) you have all rights needed in the feedback, (2) you have disclosed any compensation or benefit you received for submitting it, and (3) it complies with these terms. We have no obligation to keep your feedback confidential, to pay compensation for it, or to respond to it. We may edit or remove feedback that is unlawful, abusive, threatening, defamatory, obscene or otherwise inappropriate, or that infringes intellectual property. Feedback must not infringe third-party rights or contain viruses or malicious code; you may not use a false email address or impersonate another person. You are responsible for the content of your feedback; we are not responsible for feedback posted by you or by third parties.
12. Errors, inaccuracies and omissions
The services may contain typographical errors, inaccuracies or omissions in product descriptions, prices, promotions, shipping costs, transit times or availability. We reserve the right to correct them, to update information and, where information is clearly incorrect, to cancel an order, even after it has been submitted. If we cancel an order after payment has been received, we will refund the amount paid.
13. Prohibited uses
13.1 You may use the services only for lawful purposes. You may not use them, directly or indirectly: (a) for any unlawful or harmful purpose; (b) to violate any international, national or local regulations; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, defame, intimidate or harm anyone, including our employees; (e) to transmit false or misleading information; (f) to submit or upload material that does not comply with these terms; (g) to send advertising or promotional material, in particular unsolicited email, chain letters or spam; (h) to impersonate any person or entity; (i) to engage in other conduct that restricts others' use of the services or could harm us, Shopify or users of the services.
13.2 You also may not: (a) upload or transmit viruses or other malicious code; (b) unlawfully reproduce, duplicate, copy, extract, sell or exploit any part of the services; (c) collect or track the personal information of others; (d) send spam or engage in phishing or pharming; (e) use robots, spiders, scraping tools or other automated means to access the services in violation of section 14; (f) circumvent or interfere with security or authorisation features or other measures we use to restrict access to the services. If we find a violation, we may suspend, deactivate or terminate your account.
14. Automated tools and agents
14.1 An "agent" is software or a service that performs autonomous or semi-autonomous actions on behalf of a person or entity without direct supervision. This section applies if such an agent accesses or interacts with the services.
14.2 An agent may access the services only in accordance with this section and not where we have asked it to refrain from access. We may restrict agent access by technical measures.
14.3 Agents must: (a) state in all HTTP/HTTPS requests that they originate from an agent and disclose its name using the user agent string "Agent/[agent name]"; (b) not conceal that access originates from an agent, and in particular not imitate human behaviour or fill in or bypass CAPTCHAs and similar measures; (c) answer truthfully any question about whether they are a human or a computer; (d) not circumvent measures by which we limit or control agent access.
15. Termination
We may end your access to the services or any part of them without prior notice if you breach these terms or the law; you remain responsible for all amounts due up to the date of termination. Termination does not affect purchase contracts already concluded or your rights under them. The following provisions survive termination: Intellectual property, Feedback, Liability, Severability, Governing law and Privacy.
16. Liability and warranties
Information in the services is for general information purposes and we strive to keep it accurate and current. We do not guarantee that the services will always be uninterrupted, secure or error-free, and for information outside a purchase contract (e.g. general website content) you rely on it at your own risk.
Goods you buy from us are covered by a statutory warranty of 24 months and by rights in respect of defects under the Complaints Policy and applicable law. Nothing in these terms limits or excludes those rights.
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, lost profits, loss of revenue, savings or data arising from or in connection with the use of the services, even if we were advised of the possibility of such damages. As against businesses, our liability for damage is limited to foreseeable damage and to the price of the goods ordered, unless the law provides otherwise. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, in particular liability for damage caused intentionally, for damage to life and health, and liability towards consumers that cannot be limited by contract.
17. Compensation
If by acting in breach of these terms or the law (in particular by infringing third-party rights through materials you provide, or by misusing the services) you cause us damage, or a third party makes a claim against us, you agree, to the extent permitted by law, to compensate us for the proven costs and damage incurred, including reasonable legal costs. We will inform you of any such claim. This provision does not apply to consumers to the extent it would conflict with consumer protection law.
18. Severability
If any provision of these terms is found to be invalid or unenforceable, it applies to the maximum extent permitted by law and the invalid part is deemed severed; the validity of the remaining provisions is not affected. If a provision conflicts with rights that a consumer cannot waive by contract, those rights apply.
19. Waiver; entire agreement
If we fail to exercise or enforce any right or provision of these terms, this does not mean we waive it. These terms, together with the Terms and Conditions, the Complaints Policy and other policies published on the website, form the entire agreement between you and us on the use of the services and replace all prior agreements and communications on this subject, including previous versions of these terms. Any ambiguity in interpretation shall not be construed against the party that drafted the terms.
20. Assignment
You may not transfer or assign this agreement or any of your rights and obligations under it without our prior written consent. We may transfer or assign our rights and obligations, and your statutory rights remain unaffected.
21. Governing law and jurisdiction
These terms and the relationships arising from them are governed by the law of the Slovak Republic. Disputes between us and a business are decided by the courts of the Slovak Republic with subject-matter and territorial jurisdiction. For consumers, nothing in this section limits their right to bring proceedings before a court at their place of residence or to rely on mandatory provisions of the law of their country of residence.
22. Dispute resolution
If you are not satisfied with how a complaint was handled or believe we have violated your rights, you may contact us with a request for redress at pbtprint@pbtprint.sk. If we reject it or do not reply within 30 days, a consumer may submit a proposal for alternative dispute resolution under Act No. 391/2015 Coll. The competent body is an authorised legal entity listed in the register kept by the Ministry of Economy of the Slovak Republic (www.mhsr.sk), for example the Slovak Trade Inspection (www.soi.sk); the consumer is free to choose. Consumers may also use the European Commission's online dispute resolution platform, where available.
23. Language and translations
These terms of service are primarily drawn up in Slovak and may also be available in other languages (e.g. English or German) for your convenience only. In the event of discrepancies, the Slovak version prevails. This does not affect provisions of applicable law that guarantee you rights in a language you understand.
24. Headings
Headings in these terms are for convenience only and do not limit or otherwise affect their interpretation.
25. Electronic communications
By using the services or placing an order you agree that we may send you transactional and service-related notices electronically, in particular by email, notice in your account or posting in the services. They may concern your orders, account, purchases, returns, these terms or other matters. You are responsible for keeping your contact details up to date.
26. Changes to the terms of service
You can always find the latest version of the terms on this page. We may update, amend or replace these terms by posting the changes on the website. We will notify you of material changes in accordance with applicable law, and the changes take effect on the date stated in the notice. Changes do not apply to orders you submitted before they were posted. If you continue to use the services after changes are posted, you accept them.
27. Contact information
Send questions about these terms to pbtprint@pbtprint.sk. You will find further contact details in our contact information policy.
